MR STEVENS ASKED THE MINISTER FOR TOURISM AND FAIR TRADING (MR LAWLOR) —

QUESTION:

With reference to recent reports of price inflation scams by Gold Coast real estate agents and as the Office of Fair Trading has responsibility to monitor fair trading practices—

(1) What is being done to put a halt to alleged real estate scams on the Gold Coast?

(2) How many agents have been found guilty and have been prosecuted?

ANSWER:

(1) Investigations are currently underway into alleged real estate scams occurring on the Gold Coast.

The Office of Fair Trading is examining the activities of various entities which have been the subject of complaints. Should evidence of contraventions of legislation administered by the Office of Fair Trading be obtained, appropriate enforcement action will be taken.

As allegations of fraud are also involved, investigators from the Office of Fair Trading recently met with officers from the Queensland Police Fraud and Corporate Crime Group.

The Office of Fair Trading also has an ongoing proactive compliance program involving officers visiting real estate agent offices and checking various aspects of the operation of the businesses.

The Office of Fair Trading has a range of enforcement actions it can use effectively against real estate agents who do not comply with fair trading laws. In the period July 2008 to June 2009, the Office of Fair Trading finalised 6 court or tribunal actions and 25 infringement notices were issued by the Gold Coast Office of Fair Trading
